Master Fee Agreement
Used by both buyer and seller reps to secure a fee for a real estate transaction. The MFA consolidates two or more separate but related agreements (such as NCND and LOI) between the same counterparties in one legal document.
Use: Bulk sales of commercial and residential properties. Used in conjunction with a REO bulk purchase agreement.

Non-Disclosure/Non-Circumvent (NCND) Agreement
A form agreement whereby each party agrees to not disclose any information to third parties.

Letter of Intent
A letter of intent or LOI is a document outlining an agreement between two or more parties before the agreement is finalized. The purposes of an LOI may be: to clarify the key points of a complex transaction for the convenience of the parties; to declare officially that the parties are currently negotiating; and to provide safeguards in case a deal collapses during negotiation.
Use: In conjuction with a master fee agreement and REO bulk sales agreement.

REO Bulk Purchase Agreement
An purchase agreement between two parties for the purpose of selling a multiple bulk REO properties.
Use: Bulk sales of commercial and residential properties. Used in conjunction with a master fee agreement and letter of intent.

Assignment Agreement
Used to assign rights in a purchase agreement from one party to another for a fee.
Use: Used in conjunction with a purchase agreement for a single family residence as an addendum to a purchase agreement.

Notice of Interest
A document to be recorded at the county courthouse to protect the buyer’s interest in the property. By recording an NOI, prevents the seller from selling to any other party until you release the NOI.
Use: In conjuction with a sales and purchase agreement.

Seller’s Acknowledgement
An addendum included with a purchase agreement typically used for the purchase of a single family residence to provide additional protection against a seller who attempts to renege or cancel the purchase and sales contract because of duress, coercion or for any other reason.

Power of Attorney
Grants you control of a property on behalf of the owner.

Attorney Disclaimer
A document signed by the buyer providing evidence that you have not provided legal advice or represented yourself as an attorney.
Use: In conjunction with a sales and purchase agreement.

Answer to Complaint
A document used in response to a foreclosure notice (Lis Pendens) filed against a note holder.
Use: In conjunction with a foreclosure notice. The note holder should be the only one to complete and submit this document. This document helps the buyer to obtain additional time to negotiate the sale of the property through a short sale.

Warrantee Deed
A deed where the grantor (seller) guarantees that he or she holds clear title to a piece of real estate and has a right to sell it to the grantee (buyer).
Use: Ownership in the property purchased recorded at the county courthouse.
